Terms and Conditions

§ 1 Scope

These Terms and Conditions apply to all orders placed through the online shop of Prominente Haare, a brand of Hunger Halt UG (haftungsbeschränkt), Falkenseer Chaussee 32, 13583 Berlin, Germany (“we”). The contracting party is Hunger Halt UG (haftungsbeschränkt).

A “consumer” under these terms is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

§ 2 Conclusion of Contract

The presentation of products in the online shop is not a legally binding offer but an invitation to place an order.

By clicking the button that completes the order in the final step of checkout, you submit a binding offer to buy the goods in your cart. Until that step you can review and correct your entries at any time by going back to the cart or the previous steps, or by cancelling the checkout.

We confirm receipt of your order by email. The purchase contract is concluded when we accept your order with an order confirmation email.

The contract language is German or the language in which you went through checkout. We send you the contract text (order details) by email with the order confirmation; you can also view your order via order tracking or in your customer account. You can access and print these terms at any time on our website.

§ 3 Prices and Payment

All prices are final prices and include statutory VAT where applicable. For deliveries to countries outside the EU, German VAT is not charged in accordance with the statutory rules. The final price shown during checkout, in the currency shown there, is decisive. Shipping costs are shown separately during checkout.

We offer the payment methods shown during checkout, in particular credit card, PayPal, Klarna, Apple Pay, Google Pay, iDEAL and other payment methods via our payment provider Stripe. Which payment methods are available in a particular case depends on the delivery and residence country. We reserve the right to exclude individual payment methods in specific cases, in particular where there is a justified suspicion of non-payment or abuse.

The purchase price is due immediately upon conclusion of the contract. If you are in default of payment, statutory default interest applies. If a returned direct debit or chargeback for which you are responsible causes us costs, you must reimburse those costs; you remain free to prove that the damage was lower.

Customs duties, import VAT and other charges levied on import into your country are borne by the customer.

§ 4 Delivery, Transfer of Risk and Delivery Obstacles

Delivery areas, delivery times and shipping costs are set out in our Shipping Policy. The delivery times stated there and during checkout are estimates unless a binding delivery date has expressly been agreed.

If goods cannot be delivered, or not on time, for reasons we are not responsible for (e.g. failure of our supplier, force majeure such as natural events, strikes, epidemics or official measures), we will inform you without delay. If the goods are permanently unavailable, we are entitled to withdraw from the contract and will refund any payments already made without delay.

You must provide a complete and correct delivery address. If we incur costs because a shipment cannot be delivered due to incorrect or incomplete information, or because you refuse or do not collect the shipment, you must reimburse those costs to the extent you are responsible. Merely refusing delivery is not a withdrawal; a withdrawal must be declared expressly in accordance with § 5.

For consumers, the risk of accidental loss or deterioration of the goods passes only when the goods are handed over to you or a person authorised by you to receive them. If you expressly requested that the parcel be left at a specific place (e.g. a permission to deposit), leaving it there counts as handover.

Partial deliveries are permitted where reasonable for you; this does not cause you additional shipping costs.

§ 5 Right of Withdrawal

As a consumer you have a 30-day right of withdrawal from receipt of the goods. Details and the exceptions (in particular sealed hygiene products whose seal has been removed) are set out in our Withdrawal Policy.

§ 6 Vouchers and Discount Promotions

Voucher and discount codes can only be redeemed within the stated promotion period, for the stated products and from the stated minimum order value. Only one code can be redeemed per order; codes cannot be combined with each other or with other promotions, are not transferable and cannot be paid out in cash.

If a code is expressly limited to one redemption per customer, this applies per person or household. In case of abuse (e.g. circumventing the limit with multiple customer accounts or email addresses) we reserve the right to charge the discount retroactively or to cancel the order.

If only part of an order is withdrawn, a discount granted is taken into account proportionally; the amount refunded is the price actually paid for the returned goods.

§ 7 Product Descriptions, Colour and Natural Variations

We show colours and products as accurately as possible. However, how colours appear depends on your screen and its settings; we cannot guarantee that your device displays every colour exactly. Minor colour deviations from the display in the shop are therefore not a defect.

With hair products, minor variations in shade, texture and length are possible due to the nature of the product. These are not a defect unless the deviation is significant or impairs suitability for the purpose contractually assumed. For individual colour advice, please use our colour service.

§ 8 Retention of Title

The delivered goods remain our property until the purchase price has been paid in full.

§ 9 Warranty

The statutory warranty rights apply. For new goods the warranty period is two years from delivery of the goods.

Defects caused by improper use, treatment or care of the goods (e.g. excessive heat, unsuitable colouring or care products, incorrect installation or removal, damage by third parties) do not give rise to warranty claims.

If you notice defects or transport damage, please inform us without delay at hello@prominentehaare.com and attach photos of the goods and packaging. This is not a condition of your statutory rights but speeds up handling. We may require that the goods complained about be sent back to us for inspection; in the case of a justified defect we bear the return costs.

§ 10 Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and to the extent of any guarantee we have given.

For slightly negligent breach of essential contractual obligations (obligations whose fulfilment makes proper performance of the contract possible in the first place and on which you can regularly rely), our liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded.

Costs of third parties, for example hairdresser or installation services, are only recoverable within the liability rules above. These rules also apply for the benefit of our legal representatives and vicarious agents.

§ 11 Quantity Limits and Resale

We supply only in quantities customary for households. We reserve the right to reduce or refuse orders that evidently do not serve private needs. For larger quantities and resellers, please contact us via our contact form.

§ 12 Data Protection

Information on how we process your personal data can be found in our Privacy Policy.

§ 13 Governing Law and Jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only to the extent that the protection granted by mandatory provisions of the law of the state in which you have your habitual residence is not withdrawn.

If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes is Berlin.

§ 14 Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 15 Language and Final Provisions

These terms are available in several languages. Translations are for information only; in case of discrepancies the German version prevails. If individual provisions are invalid, the validity of the remaining provisions is unaffected.
